Description of Service

Our Service provides AI-powered Twitter (X) reply automation, content generation, and engagement tools. Contagent uses artificial intelligence to analyze your writing style and generate replies that match your voice, enabling you to scale your Twitter engagement automatically. Features include voice-matched AI replies, smart targeting via keywords, VIP accounts, and Twitter lists, as well as real-time analytics and approval workflows.

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration

You may be required to create an account to access certain features of the Service. You agree to provide accurate and complete information during the registration process and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

Twitter Account Integration

To use the Service, you must connect your Twitter (X) account via OAuth authentication. By connecting your account, you authorize Contagent to access your Twitter data, including your tweets, profile information, and engagement metrics, for the purpose of providing the Service. You acknowledge that:

• You are the authorized owner of the connected Twitter account.
• Automated replies will be posted using your Twitter account's API credentials and count toward your account's rate limits.
• You are responsible for ensuring your use of the Service complies with Twitter's Terms of Service and API policies.
• Contagent is not responsible for any actions taken by Twitter against your account, including suspension or restriction, resulting from your use of the Service.

AI-Generated Content

The Service uses artificial intelligence to generate replies and content on your behalf. You acknowledge and agree that:

• AI-generated content may not always be accurate, appropriate, or aligned with your intended messaging. You may use approval mode to review content before it is posted.
• You are solely responsible for all content posted through your Twitter account via the Service, whether or not you reviewed it prior to posting.
• Contagent does not guarantee specific results, engagement metrics, or follower growth from the use of AI-generated content.

Use of the Service

You agree to use the Service in compliance with all applicable laws and regulations. You must not:

• Use the Service for any illegal or unauthorized purpose.
• Use the Service to harass, spam, or abuse other users on Twitter or any platform.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Attempt to circumvent rate limits, usage quotas, or safety mechanisms built into the Service.
• Engage in any activity that could harm or impair the performance or security of the Service.
• Resell, sublicense, or redistribute access to the Service without our written consent.

Payment and Subscriptions

Certain features of the Service require a paid subscription. By subscribing to a paid plan, you agree to the following:

• Free Trial: New users receive a 10-day free trial with no credit card required. After the trial period, you must subscribe to a paid plan to continue using the Service.
• Billing: Subscription fees are billed monthly through our payment processor, Stripe. You authorize us to charge your payment method on a recurring basis.
• Cancellation: You may cancel your subscription at any time through your account settings or the Stripe customer portal. Cancellation takes effect at the end of your current billing period.
• Refunds: Subscription fees are generally non-refundable. If you believe you are entitled to a refund, please contact us.

Privacy

Intellectual Property

All intellectual property rights in the Service, including but not limited to software, design, text, images, and trademarks, are owned by us or our licensors. Termination

Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not warrant the accuracy or reliability of AI-generated content.

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the Service; (d) any bugs, viruses, or similar issues that may be transmitted to or through the Service by any third party; (e) any errors or omissions in any content, including AI-generated content, or for any loss or damage incurred as a result of the use of any content posted through the Service; and/or (f) the defamatory, offensive, or illegal conduct of any third party.

Indemnification

You agree to indemnify, defend, and hold harmless Contagent and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your use of the Service, your violation of these Terms, or any content posted through your account via the Service.

Changes to the Terms

We may revise these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website or through other communications. By continuing to use the Service after such changes, you agree to the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.
